Symposium
Since 1993, the University of Regensburg has hosted symposia on European family law, during which numerous current issues in family law have been examined from a European comparative law perspective.
14th SYMPOSIUM ON EUROPEAN FAMILY LAW
Family Law and Religion – European Perspectives
14–16 March 2019 / Vielberth Building (H 24 (external link, opens in a new window))
Since the 18th century, the development of European family law has been characterised by states increasingly replacing religiously influenced norms with a uniform legal system for all citizens, guided by the principles of secular, rational legal policy.
Nowadays, the relationship between family law and religion is once again a topical issue: the notion of a tension-free coexistence between state law and personally practised religious ethics does not always correspond to reality. Furthermore, the courts cannot avoid taking certain account of religious sensitivities. This issue is given particular impetus by the fact that, as a result of migration, European states are increasingly having to grapple with legal systems of countries in which family law is still shaped by religion or where the process of secularisation has not yet been completed. The issues described and the ways to resolve them will be discussed and explored in greater depth through a comparison of the situation across different legal systems.
The 14th Symposium will focus on the religious implications in the law governing couple relationships and in the law of parentage, as well as the resulting challenges for private law.
