“Inclusive Administration – The Temporary Move from the Private Sector to the Civil Service” (external link, opens in a new window) refers to an exchange programme that the Federal Government continues to run to this day. Under this programme, staff from associations, companies or non-governmental organisations can work in ministries in the same capacity as civil servants. This is done on the basis of an administrative regulation. Professor Hartmann assesses the programme against the requirements of the Basic Law, in particular the principle of the rule of law. He puts forward a proposal on how the “level of neutrality under the rule of law” – which must be achieved under constitutional law – can be determined. The monograph grew out of a lecture given by Hartmann as a member of the Young Academy of the North Rhine-Westphalian Academy of Sciences and Arts. It is now permanently available to all under an ‘open access’ licence.
