Professor Hartmann’s doctoral thesis is now available via Open Access. “Popular Legislation and Constitutional Rights” examines the process of popular legislation, which is now practised in all the federal states of the Federal Republic of Germany. In this treatise, Hartmann attempts to determine, at each stage of the direct legislation process, whether citizens are exercising state power (subject to fundamental rights) or enjoying their freedom (as guaranteed by fundamental rights). The Faculty of Law at the University of Münster awarded the thesis the 2004 Harry Westermann Prize (1st place).
