Lecture on the Code of Civil Procedure II – law of enforcement

Introductory lecture for the 4th–5th semesters. Recording of the lecture delivered via Zoom in the winter semester 2020/2021. The lecture, supported by PowerPoint, consists of 16 sessions. The course material provides a comprehensive overview of enforcement proceedings, including legal remedies under enforcement law and interim relief.

The PowerPoint slides accompanying the video podcast have since been updated to reflect the current state of legislation (the Act to Improve the Protection of Bailiffs against Violence and to Amend Further Provisions of the Law of Enforcement of 7 May 2021). In this context, Section 811 of the Code of Civil Procedure (ZPO) (Assets and animals exempt from attachment) has been revised in particular.

The ZPO written exam, 4th edition 2024 (external link, opens in a new window)

A guide to solving cases relating to contentious proceedings and enforcement. Guidance on addressing the key issues in civil procedure. 4th edition, Munich 2024, 275 pages, published by C.H.Beck.

This volume presents civil procedure law through case studies. It addresses the main issues in contentious proceedings and the law of enforcement from the perspective of a student required to solve a case as part of their studies or in an examination. Of particular significance are the key pointers to difficulties and errors that recur time and again when working through cases.

Excerpt from the review by Nowesky in ZJS 2024, 624 ff.: (external link, opens in a new window) “It is noteworthy, first of all, that – unlike all too often – the new edition has not led to an increase in the book’s length. With the fourth edition, this already concise work has been slimmed down by just under 40 pages. This can be attributed to what is arguably one of the book’s and the authors’ greatest strengths: their skilful prioritisation of content. Topics less relevant to the exam are discussed briefly, whilst exam-relevant material and actual problem areas are covered in due detail. At no point do the two authors lose their way in dogmatic digressions. [...] The fourth edition of the book *Die ZPO-written exam*, presented by Schumann and Heese, fully lives up to its own claim – already set out in the subtitle – of being a guide to solving cases relating to contentious proceedings and enforcement. The work succeeds not only in imparting knowledge, but also in developing the competence required to solve exam questions independently."
